Assumption of Risk and Liability Waiver Agreement
I acknowledge that Cucuro Adventures hires guides that are trained in the areas of safety, risk assessment and backcountry medicine, yet these skills and certifications do not negate the possibility of risks. Although Cucuro Adventures has taken reasonable steps to provide me with appropriate equipment and skilled guides so I can enjoy an activity for which I may not be skilled, Cucuro Adventures has informed me this activity is not without risk. Certain risks are inherent in each activity and cannot be eliminated without destroying the unique character of the activity. These inherent risks are some of the same elements that contribute to the unique character of this activity and can be the cause of loss or damage to my equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death. Cucuro Adventures does not intend to temper my enthusiasm for this activity, but believes it is important for me to know in advance what to expect and to be informed of the possibility of inherent risks. I,____________________________________ , hereby acknowledge that I am aware that during the trip or vacation that I am participating in under the arrangements of Cucuro Adventures, and its agents or associates, certain risks and dangers may arise, including, but not limited to: the hazards of travelling in mountainous terrain, such as falls, avalanches, altitude sickness, hypothermia, equipment failure, the forces of nature, civil unrest, terrorism, travel by aircraft, boat, automobile, bus, elephant, or other means of conveyance, and accident or illness in remote regions without means of rapid evacuation or availability of medical supplies and facilities. I acknowledge that, in part, the enjoyment and excitement of adventure travel is derived from the inherent risks of activities and travel that may be beyond those levels normally encountered at home or work, and that these risks, and the associated excitement are a major reason for my participation. I agree that if I suffer injury or illness, Cucuro Adventures can, at my cost, arrange medical treatment and emergency evacuation service as Cucuro Adventures deems essential for my safety. As lawful consideration for being permitted by Cucuro Adventures to participate in such trips and activities, I hereby agree that I will not make a claim against Cucuro Adventures, or sue for bodily injury, death, emotional trauma, and/or property damage resulting from the acts of any employee, agent or contractor of Cucuro Adventures, as a result of my participation on this trip. I hereby release Cucuro Adventures and its agents and employees from and against any and all liability arising out of or connected in any way with my participation on the trip. This agreement is entered into on behalf of all members of my family, including any minors accompanying me. This agreement is binding on my heirs, legal representatives, and assigns. If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect. Under no circumstances shall Cucuro Adventures be liable to any trip participant for more than $500. All applications are subject to acceptance by Cucuro Adventures. I further understand that Cucuro Adventures reserves the right to refuse acceptance to anyone it judges incapable of meeting the rigors and requirements of participating in any activity or trip at any time. I have carefully read this agreement and fully understand its contents. I am aware that this is a release of liability and a contract between me and Cucuro Adventures and/or their affiliated organizations and sign it of my own free will. I also acknowledge that I have carefully read Cucuro Adventures' booking information including its policy on cancelled trips and refunds, and agree to all stated conditions set forth in the booking information.
